Diversey Training Solutions General Terms and Conditions
1. Introduction
The Training Solutions Website (the Website) is a communications programme set up and administered by Diversey
for employees of registered customers. This Programme shall be for the UK. To join the Website you can complete a registration form online.
2. Participation
Access to the Website is open to persons who hold a managerial position with a registered customer. Participants must
be approved by Diversey and must be willing to provide personal details, including but not limited to first and last names, company
name, company address, post code and city. Use of this website is subject to the terms and conditions contained in this Agreement, and
registration on the website constitutes acceptance of these. It is the responsibility of the registered company to notify Diversey
when an existing Participant leaves their employment and in consequence will lose their rights to access the site. For security reasons a
validation email will be periodically sent to all users.
3. Personal Details
The Participant’s personal details are entered into the Diversey member registration system. This data is handled
confidentially and can be used both for identification and recognition purposes, and for research, analysis, internal reporting and direct
marketing activities, to the specific customers. It is also used to monitor use of the site and to help its further development.
Diversey shall ensure that the services provided under this Agreement comply with all applicable laws and regulations, including any
data privacy and protection laws. Correspondence relating to the Website will be sent to the user’s last registered address.
If you view or download information, we may register your visit by using so-called cookies. Cookies are pieces of information that a website
copies to your computer's hard drive for registration purposes. These cookies enable Diversey to tailor the information to your preferences.
Diversey never uses cookies to retrieve information from your computer. If you do not wish to use cookies, you must change the setting to
"cookies off" in your browser or click on the "cookies off" button. This can restrict the use of our website and services.
4. Changes to the Services and Programme
Diversey reserves the right to change the Website or the terms and conditions of this Agreement with 30 days prior
notice. All third-party software that can be downloaded from a site that is hosted by a third party and to which is referred to on this site
or for which a link is provided on this site, falls under the responsibility of the third party and not under the responsibility of
Diversey.
5. Intellectual Property
Users of the Website do not acquire any right, title or interest in any of the trademarks or trade names of Diversey
by virtue of this Agreement, and the user shall not use or in any way refer to Diversey’s trademarks or trade names except for purposes
of this Agreement as set forth herein. The user does not acquire any right title or interest in any of the intellectual property ( including
but not limited to trade secrets, know how, patents, copyrights and formulas) owned by, licensed to or used by Diversey, which the user
learns, has access to or uses in the course of the performance of this Agreement.
In respect of the web site you are permitted to browse the site and to reproduce extracts by way of printing, downloading to hard disk, and by
distribution to other people, but in all cases for information purposes only and provided that the above intellectual property notice appears
in all such publications. No reproduction of any part of the site may be sold or distributed for commercial gain, nor shall it be modified or
incorporated in any other work or publication, whether in hard copy or electronic format, including posting to any other site. No licence or
right is granted.
6. Warranty
Within the task card methodology, Diversey strives to follow best practise guidelines. It is the Participants
responsibility to ensure appropriate Health and Safety Regulations are adhered to, including but not limited to Personal Protective Equipment
and Risk Assessments.
7. Limitation of Liability
Diversey shall not be liable to the user for any loss of profit or other indirect, special or consequential costs,
expenses, goodwill, loss or damage with arises out of or in connection with the use of this Website. Diversey shall not be responsible
for any incorrect information, nor for damage to or removal of the user’s information. Diversey shall not be responsible for any damages,
costs or expenses that arise following cancellation of the Website. Diversey is not responsible for and cannot be held liable for any losses,
damage, viruses or any other harm resulting from downloading such software. All safety advice contained within the Website must be read in
conjunction with the appropriate Material Safety Data Sheet and other Product Information Sheets.
8. Availability of Products
Any reference to any product or service on this Website does not constitute an offer to sell or supply that product or service.
9. Dispute Resolution
This Website has been developed specifically for use in the UK, and is subject to English Law. Any disputes that arise in
connection with this Website shall be submitted and resolved according to the laws England and Wales in which the dispute arises.
10. Termination
Diversey reserves the right to cancel the Website at any time.
11. Privacy and email address
On registration Diversey requests an e-mail address in order to be able to contact you. You can also provide private data
by e-mail on your own initiative in order to, for example, request information about Diversey, products or services.
Information that Diversey sends by e-mail is only intended for the party to whom it is addressed. Use of this information by parties
other than the addressee is not permitted. Copying, publishing, distributing and/or providing this information to third parties is not permitted.
Diversey does not guarantee the correct and complete communication of the content of sent e-mail or for its timely receipt. No rights may
be derived from the information sent to you.
12. Your questions, suggestions and comments made on the 'contact us' page
Diversey does not wish to receive confidential information via this page, or information that is subject to copyright
or that is protected by you or third parties in any other way. Diversey regards all types of information, in the form of suggestions,
ideas, etc. that it receives from you as non-confidential and free of rights of ownership. Diversey reserves the right to use, reproduce,
change, demonstrate, pass on and distribute this information.
